Allmänt
Hos FlyBy AB, org.nr 559047-1396, nedan benämnt FlyBy, tillhandahåller flygsimulatorer för träning och utbildning av piloter. Privatpersoner och företag kan komma och uppleva hur det är att flyga som pilot i våra flygsimulatorer.Den som köper en upplevelse benämns nedan som Kund. Upplevelsen tillhandahålls på vår anläggning i Malmö.

Om våra flygsimulatorer
Våra simulatorer rör inte på sig men med ett 220 graders realistiskt visuellt system kan det finnas risk för att uppleva åksjuka.Vid osäkerhet eller frågor kring detta ombeds Kund att kontakta FlyBy för mer information.

Avbokningsvillkor
Bokad tid kan inte avbokas men är ombokningsbar. Ombokning för aktiviteten måste ske senast 72h före inbokad tid. Vid händelse av sjukdom kan bokad tid ombokas fram till genomförandet ska påbörjas mot uppvisade av läkarintyg. Kostnad för inbokad aktivitet kan inte återfås i efterhand om Kund inte nyttjar sin inbokade tid.

För företagskunder gäller separata villkor enligt offert.
För våra kurser i flygrädsla gäller separata villkor.

Presentkort 
FlyBy säljer presentkort till våra upplevelser. Dessa presentkort kan nyttjas på www.boka.se/flyby där de kan lösas in via det digitala bokningssystemet och tid kan bokas för köpt upplevelse. Angiven tidsåtgång står på presentkortet.

Giltighetstid 
På presentkort anges en giltighetstid om 12 månader från köptillfället. Presentkort måste nyttjas inom giltighetstiden. I annat fall anses presentkortet förbrukat. Ett presentkort/värdebevis som har passerat giltighetsdatum kan ej förlängas eller användas som betalningsmedel.

Öppet kör / Ångerrätt
FlyBy tillämpar 14 dagars öppet köp under förutsättning att upplevelsen inte redan har nyttjats eller tid har bokats. Det innebär att du som handlat har rätt att ångra ditt köp inom 14 dagar och få pengarna tillbaka. Gäller ej företagsköp. För köp hos en av våra återförsäljare .

Har du köpt upplevelsen hos en återförsäljare gäller deras regler för öppet köp och du kontaktar då respektive återförsäljare.

Återbetalningar görs till köpande kund mot uppvisande av kvitto. Kortköpsretur återbetalas till samma kort. Vid betalning med faktura görs återbetalning till fakturamottagare. Återbetalning motsvarar belopp inbetalt enligt kvitto.  

Särskilda erbjudanden
FlyBy kan med kort varsel göra erbjudande. För dessa erbjudanden gäller särskilda villkor vilka framgår vid tiden för varje erbjudande.

Tekniska problem 
FlyBy äger rätten att boka om Kundens tid om det uppstår tekniska problem med simulatorn.

Force Majeure 
FlyBy är befriat från ansvar om FlyBy ej kan fullgöra sina åtagande mot Kund på grund av en extern händelse ingen av parterna har någon del i eller kontroll över. Det avser en händelse som är onormal eller var oförutsebar och vars följder medför ett oöverstigligt hinder för FlyBy att fullfölja sina åtaganden helt eller delvis. Exempel på sådan händelse kan vara, men är inte begränsat till, krig, blixtnedslag, översvämning eller annan naturkatastrof, elavbrott, eldsvåda eller ändrad lagstiftning.

General Terms and Conditions for FlyBy AB, Org. No. 559047-1396

General
At FlyBy AB, org. no. 559047-1396, hereinafter referred to as FlyBy, we provide flight simulators for the training and education of pilots. Individuals and companies can come and experience what it is like to fly as a pilot in our flight simulators. The person purchasing an experience is hereinafter referred to as the Customer. The experience is provided at our facility in Malmö.

About Our Flight Simulators
Our simulators do not move, but with a 220-degree realistic visual system, there may be a risk of experiencing motion sickness. If unsure or if you have questions about this, the Customer is requested to contact FlyBy for more information.

Cancellation Policy
Booked time cannot be canceled but can be rescheduled. Rescheduling for the activity must occur at least 72 hours before the booked time. In the event of illness, the booked time can be rescheduled up until the activity is to begin upon presentation of a medical certificate. The cost for a booked activity cannot be refunded afterward if the Customer does not use their booked time.

For corporate customers, separate terms apply according to the quote.
Separate terms apply to our courses for fear of flying.

Gift Cards
FlyBy sells gift cards for our experiences. These gift cards can be used at www.boka.se/flyby where they can be redeemed via the digital booking system and a time can be booked for the purchased experience. The specified duration is stated on the gift card. Validity Period The gift card indicates a validity period of 12 months from the purchase date. The gift card must be used within the validity period. Otherwise, the gift card is considered expired. A gift card/voucher that has passed the validity date cannot be extended or used as a means of payment.

Right of Withdrawal
FlyBy applies a 14-day right of withdrawal provided that the experience has not already been used or a time has been booked. This means that you who have made a purchase have the right to cancel your purchase within 14 days and get your money back. Does not apply to corporate purchases.

For Purchases from One of Our Resellers
If you purchased the experience from a reseller, their rules for returns apply, and you should contact the respective reseller. Refunds are made to the purchasing customer upon presentation of a receipt. Card purchase returns are refunded to the same card. For payments by invoice, the refund is made to the invoice recipient. The refund corresponds to the amount paid according to the receipt.

Special Offers
FlyBy may offer special deals on short notice. Special conditions apply to these offers, which are stated at the time of each offer.

Technical Issues
FlyBy reserves the right to reschedule the Customer's time if technical problems with the simulator arise.

Force Majeure
FlyBy is exempt from liability if FlyBy is unable to fulfill its obligations to the Customer due to an external event that neither party has any part in or control over. This refers to an event that is abnormal or was unforeseeable and whose consequences create an insurmountable obstacle for FlyBy to fully or partially fulfill its commitments. Examples of such events can be, but are not limited to, war, lightning strike, flood or other natural disaster, power outage, fire, or changed legislation.

But, if instructor use HEVC compression, it's the instructor's responsibility to pay the royalties to the MPEG-LA, the owner of HEVC patents as appropriate.
